Federal Government Will Not Fight Lawsuit Against Hispanic-Serving Institutions

Earlier this summer, Students for Fair Admissions and the State of Tennessee joined together to sue the Federal Government over the Hispanic-Serving Institution program. SFFA (the people behind the Harvard lawsuit that overturned any use of race in admissions) and Tennessee alleged this program violates the Equal Protection Clause of the 14th Amendment to the United States Constitution because it gives benefits to colleges with large Hispanic populations. Earlier this week, the Justice Department issued a one-page memo saying it will not defend the program against the lawsuit. Consider the lawsuit mostly successful at this point.
